These Terms govern your use of Nash, an AI shopping concierge provided by Pier39, Inc. ("Pier39," "we," "us"). By installing the Nash browser extension or placing an order through Nash, you agree to these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use Nash or place an order, and you agree to use Nash only for lawful, personal, non-commercial purposes.
1. What Nash does
Nash helps you shop. It detects the product you're viewing, finds pricing across its merchant network and public sources, and — when you ask — completes a purchase on your behalf. You review and approve every purchase before any payment is made; Nash never places an order without your explicit confirmation.
2. How purchases work
When you confirm a purchase, you pay Pier39 through our payment processor, Stripe. Pier39 then places the corresponding order with the merchant using the shipping and contact details you provide. The merchant ships the item to you and sends you its own order confirmation. Pier39 acts as your buying agent for that transaction; we are not the manufacturer or, unless expressly stated, the merchant of record.
You are responsible for providing accurate product, variant, shipping, and contact information. We are not liable for issues arising from inaccurate information you provide.
Orders we review before placing. Some orders are held for a short manual review before we place them with the merchant — for example when we cannot independently confirm the merchant's price. Your payment is taken at checkout as usual, but the order is not placed with the merchant until that review clears. If we decide not to fulfill a held order, we cancel it and refund you in full (see Section 5).
3. Pricing
Prices shown are sourced live at the time of your request and may change before you complete checkout. Nash does not add a markup and does not claim a special or negotiated discount off the merchant's price — the amount you pay for an item is the merchant's current listed price, plus any shipping cost and applicable US sales tax calculated at checkout. Your savings come from Nash Cash applied to your order (see Section 4), not from a change to the merchant's price. Nash currently ships to US addresses and prices in US dollars. We make reasonable efforts to show accurate prices but do not warrant that any price is error-free; if a price is materially wrong, we may decline or cancel the order and refund you.
Shipping. Where the merchant charges for shipping, that cost is shown on your confirmation card before you pay and is included in the total you are charged; where shipping is free, no shipping is added. The total you confirm is the total you pay — if the merchant's actual shipping cost turns out to be higher than what we showed you, Pier39 absorbs the difference and does not charge you more.
4. Nash Cash
Nash Cash is a promotional credit earned on eligible Nash purchases. It has no cash value, is not redeemable for cash, cannot be transferred, and applies only toward future Nash purchases. Nash Cash expires 14 days after it is issued. We may modify, suspend, or revoke Nash Cash, and may withhold or claw back credits obtained through error, fraud, abuse, self-referral, or a purchase that is later refunded or cancelled.
5. Cancellations, returns, and refunds
If we cannot fulfill your order, we will refund you, generally within 24 hours. Once an order is placed with a merchant, returns and exchanges follow that merchant's own policy — contact us and we will help facilitate. Refunds are issued to your original payment method via Stripe.
Discount codes you provide. If you give Nash a discount or promo code, Nash applies it when it places your order with the merchant. Your card is charged the pre-discount total at checkout; if the code is accepted at the merchant, we refund the difference to your original payment method (typically within a few days), and if it is not accepted you simply pay the normal total and are never charged more. We apply and verify these codes manually, so this refund is not instant. We are not responsible for a merchant's decision to honor or reject a code.
6. Referrals
Referral links and codes are for personal, non-commercial sharing. We may void referral rewards obtained through spam, misrepresentation, or abuse.
7. Acceptable use
You agree not to misuse Nash, including: using it for unlawful purchases; attempting to manipulate prices, discounts, or Nash Cash; probing, scraping, or overloading our systems; or reselling access. We may suspend or terminate access for violations.
8. Merchants and third parties
Nash surfaces products from third-party merchants and data sources. We do not control and are not responsible for merchant products, availability, pricing, fulfillment, or policies. References to merchants do not imply endorsement or affiliation unless expressly stated. Payment is processed by Stripe and AI features are powered by third-party model providers, each under their own terms.
9. Disclaimers
Nash is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that pricing, availability, or the service will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Pier39's total liability for any claim arising out of or relating to Nash or a transaction is limited to the amount you paid for the transaction giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Changes
We may update these Terms. Material changes will be reflected by the "Last updated" date above; continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Venue for disputes lies in San Francisco County, California.
